Multi Mags entered into an oral agreement to hire Joanna Green as a magazine salesperson. As part of her contract for employment, she was paid a commission for each magazine subscription that she sold and would also receive a commission for each renewal on those original subscriptions. For example, if she sold a two year subscription to People Magazine, she would receive a commission on that original subscription. If the customer renewed after the initial two year subscription, Joanna would get another commission even if she had no contact with the customer at the time of renewal. After five years, Joanna quits her job to go work as a dental hygienist. However, Multi Mags stopped paying her the commissions on the renewals. She files suit in the Circuit Court for Montgomery County Maryland alleging breach of contract. Multi Mags files a motion for summary judgment defending that the contract is unenforceable under the statute of frauds as the contract lasted more than one year.
